Application
- These general rental conditions apply to reservations and agreements regarding the hiker's cabins "Koningsspil and Bonkelaar" located at Puoldyk 69, postcode 9035 VC in Dronrijp.
- In these general rental conditions, the term “tenant” means: the person who enters into a rental agreement with us regarding the rental of the holiday home.
- These general terms and conditions apply regardless of your (prior) reference to any of your own terms and conditions or to other general terms and conditions. We reject all general terms and conditions that you refer to or that are used by you.
- Agreements that deviate from these general terms and conditions are only valid if agreed in writing.
Article 1 - Reservations
- We only accept reservations from persons who are 21 years or older. Reservations from persons under that age are also not valid. We reserve the right to refuse a reservation at any time – without giving reasons.
- The person in whose name the hiker's cabin is rented is the main tenant, and as such also liable for any damage caused by any of his or her party that occupies the hiker's cabin. The rental agreement is personal, and cannot be transferred to someone else.
- We request that you check these documents for accuracy and notify us immediately of any inaccuracies.
Article 2 - Payment
- Payments must be made online through the reservation system.
Article 3 - Deposit
- No deposit will be charged to the tenant.
- If you find any damage upon arrival, we kindly ask you to report this immediately so that we do not hold you liable.
- In the event of unreported damage that we discover after departure, this may be a reason to send the tenant an invoice to recover the costs incurred.
Article 5 – Cancellation
Cancellation by the tenant must always be done in writing (by e-mail). The following conditions apply:
- If desired, the tenant can take out cancellation/travel insurance with a bank, insurance company or ANWB office.
- In case of cancellation up to 24 hours before the day of arrival NO rental fee is due. The full amount transferred will be refunded.
- In case of cancellation less than 24 hours before the day of arrival you will owe 100% of the rental amount. You will not get any refund of the amount made.
- In case of cancellation by us, you will NOT owe any rental fee. The full amount transferred will be refunded.
Article 6 – Receipt of key.
- The key can be obtained from the key safe at the front door of the hikers' cabin. Before arrival, you will receive the combination by email. The key to the hikers' cabin is made available to the tenant by us on loan. The key remains our property. In case of loss, theft or any other way of losing the key, the tenant owes an amount of € 50.
- Goods found after your departure will be kept for you for a reasonable period, but we will not accept any responsibility for this. Re-sending can only be at your expense.
Article 7 - Stay in the hiker's cabin
The following stay periods and times apply to reservations/stays, namely:
- The tenant and other users must behave as good tenants during their stay in and around the house and follow the house rules.
- On the day of arrival you can use the hikers' cabin from 14:00 in principle. On the day of departure you must have left the hikers' cabin by 11:00.
- The hikers cabin is non-smoking. Smoking is allowed outside on the terrace.
- No open fire may be used outside. Only at the grill area and if this has been discussed with the owner/miller.
- Pets are not allowed.
- The use of water and electricity is included, but we kindly request that you use them sparingly.
- Please use the detergent, shower gel and shampoo provided. The cabins are not connected to the sewer but to an IBA tank. The detergent, shower gel and shampoo remain our property.
- A maximum of 2 persons applies to the tractor cabin, unless otherwise agreed in writing.
- Loud parties are not allowed. (nature and peace area) This can lead to the early termination of the rental agreement on our part, without refund of the rental fees.
- Moving beds is not allowed.
Article 8 - Force Majeure
- Force majeure on our part exists if the performance of the agreement is prevented in whole or in part, temporarily or otherwise, by circumstances beyond our control, including the risk of war, strikes, blockades, fire, floods and other disruptions or events.
Article 9 - Liability/complaints/damage
- The owner has the right at all times not to accept a booking if there are price errors or occupancy errors on the website. Invoices sent by the owner and any other written documents contain all relevant data for the stay in the booked cabin.
- The tenant and other users are fully and severally liable for all damage to the house, the inventory and all items belonging to the rented object during the relevant rental period, unless the tenant and other users can demonstrate that the damage cannot be attributed to them. We therefore advise you to inspect the inventory thoroughly for defects and upon arrival at the holiday home. If you notice any damage or defects, please report this to us immediately.
- We accept no liability for theft, loss or damage of or to property or persons, of any nature whatsoever, during or as a result of your stay in the holiday home.
- We cannot be held liable for injuries and/or damage that occurs during your stay on our premises. This also applies to any (noise) nuisance caused by third parties. Also if facilities on the premises had to be taken out of use.
- We accept no liability for construction activities on the (main) roads etc. in the vicinity of. We accept no liability for the failure or decommissioning of technical equipment, utilities.
- The costs of normal maintenance and repair of defects are for our account. If defects occur, the tenant must inform us immediately and follow our instructions as much as possible.
- If you still wish to file a complaint, it must be submitted to us in writing and with reasons within 2 days of leaving the holiday home.
Article 10 - Departure and final cleaning
In case of incorrect use or incorrect leaving of the tractor hut, additional (cleaning) costs may be charged to the tenant;
- After the end of the stay, the tenant must upon departure:
- To leave the house clean and tidy
- Everything washed, dried and put back in the cupboard;
- Beds must be stripped. Duvet covers folded on the bed and linen in a pillowcase inside by the door;
- Leave the refrigerator and convection oven clean and empty;
- To bring food with you and not to leave it in the cupboard(s) and/or refrigerator/freezer;
- Having emptied the garbage cans into the gray container at the house;
- Any breakage and/or damage must be reported to the landlord.
- Please return the key to the key safe when leaving the cabin and checking out.
Article 11 - Applicable law
These conditions are exclusively governed by Dutch law. All disputes arising from the invoice and other written documents or these conditions will be settled in the first instance by the competent court in
Netherlands. Neither party may transfer its rights and obligations to third parties unless otherwise provided in the present conditions. If and to the extent that any provision in the invoice or other written documents and the present conditions should appear null and void, the conditions shall remain in force and the void article shall be deemed to have been converted in such a way that it is brought into line with the apparent intentions of the parties.
